We have published our response to the government’s ILCA consultation, setting out our significant concerns with both the proposed scheme and the consultation process itself.
It is our belief that the scheme as proposed is unfit for purpose, lacking both a clear mandate for its implementation, and robust evidence to support it. The consultation fails to identify the statutory authority for what amounts to a sector-specific tax. Furthermore, there is an absence of essential financial modelling, including assessments of administration and compliance costs for firms and financial institutions.
It is our view that the government must reconsider these proposals, take stock of emerging research, and ensure that the potential development of a future scheme carefully considers any potential impact on legal aid providers and access to justice.
